PREAMBLE
The Sovereign Catholic Indigenous and Private State of Xaragua hereby restores and permanently establishes Le Civilisateur as its official state journal of political doctrine, institutional analysis, academic publication and territorial thought.
The historical Civilisateur emerged during the nineteenth-century formation of the first organized Liberal current associated with Jean-Pierre Boyer-Bazelais, Edmond Paul and the doctrine expressed by the formula:
Le pouvoir aux plus capables.
Its historical function was political and intellectual. It provided a medium through which questions of government, constitutional organization, administrative competence, economic policy and public authority could be examined outside the immediate control of the governing administration.
The restoration of Le Civilisateur by Xaragua constitutes an institutional continuation of this intellectual function.
The restored journal shall not operate as an external electoral newspaper, a temporary campaign platform or a personal publication. It shall serve as a permanent organ through which the State, the University of Xaragua and the Liberal Party of Indigenous Ayiti publish doctrine, research, institutional analysis and political formation materials.
Le Civilisateur shall remain institutionally distinct from La Ruche.
La Ruche constitutes the official journal of state publication and public record. It publishes constitutional acts, laws, decrees, regulations, appointments and official notices.
Le Civilisateur constitutes the state journal of doctrine and analysis. It explains institutions, develops political thought, publishes academic work, examines public policy and contributes to the formation of cadres.
The two publications form separate components of one state communication system:
a. La Ruche records what the State has formally adopted;
b. Le Civilisateur develops, analyzes and communicates the doctrine through which the State understands and organizes its action.
TITLE I — NAME, STATUS AND INSTITUTIONAL POSITION
Article 1 — Official Name
The journal shall bear the permanent title:
LE CIVILISATEUR
Its official institutional designation shall be:
STATE JOURNAL OF POLITICAL DOCTRINE, INSTITUTIONAL ANALYSIS AND ACADEMIC PUBLICATION
Article 2 — Constitutional Establishment
Le Civilisateur is established as a permanent publication institution of Xaragua.
Its existence shall not depend upon:
a. an electoral mandate;
b. registration as a political party newspaper;
c. temporary government funding;
d. an individual editorial administration;
e. external academic approval;
f. continuation of a particular political campaign.
Article 3 — Institutional Character
The journal shall operate simultaneously as:
a. a state journal of political doctrine;
b. a publication organ of the University of Xaragua;
c. a doctrinal platform of the Liberal Party of Indigenous Ayiti;
d. a medium of territorial and institutional analysis;
e. an instrument for the formation of public cadres;
f. a repository of political and academic thought.
Article 4 — Non-Legislative Status
Publication in Le Civilisateur shall not, by itself, enact law, promulgate a decree or create a binding administrative obligation.
Normative state instruments shall receive their official publication through La Ruche.
A text published in Le Civilisateur shall possess binding effect only where:
a. it reproduces an instrument previously promulgated in La Ruche;
b. an authorized legal act expressly incorporates it;
c. the competent authority separately adopts it according to the applicable procedure.
Article 5 — Official Authority of Published Doctrine
An article officially designated as State Doctrine shall constitute an authoritative statement of institutional position.
Academic articles, signed opinions, historical studies and external contributions shall retain the status assigned to them in the issue in which they appear.
TITLE II — HISTORICAL LINEAGE
Article 6 — Nineteenth-Century Origin
The historical lineage of Le Civilisateur is associated with the development of the first Liberal political current during the nineteenth century.
That current sought to establish public authority upon:
a. competence;
b. constitutional government;
c. administrative capacity;
d. political accountability;
e. economic organization;
f. intellectual formation.
Article 7 — Boyer-Bazelais and Edmond Paul
Jean-Pierre Boyer-Bazelais and Edmond Paul are recognized as principal historical figures of the Liberal movement with which Le Civilisateur was associated.
Their political current advanced the public formula:
Le pouvoir aux plus capables.
The restored journal shall preserve this formula as part of its historical and doctrinal inheritance.
Article 8 — Nature of the Historical Continuity
The continuity established by this Charter is:
a. historical, through the recovery of the title;
b. political, through the doctrine of competent government;
c. intellectual, through the publication of institutional analysis;
d. territorial, through its incorporation into the political history of the island;
e. academic, through its present attachment to the University of Xaragua.
Article 9 — Absence of Organizational Identity
The restored Le Civilisateur shall not be represented as the same legal organization that published under the historical title during the nineteenth century.
It constitutes a new institutional body that formally receives and continues the title, political heritage and intellectual function of the historical journal.
Article 10 — Xaraguayan Reclamation
Xaragua receives Le Civilisateur as part of the political and intellectual inheritance available to the territorial population of the island.
Its restoration does not require permission from the Residual Administrative Unit and does not incorporate the journal into the latter’s party system.
TITLE III — PUBLICATION SYSTEM OF THE STATE
Article 11 — Dual Publication Architecture
The State publication system shall consist principally of:
a. La Ruche, Official Journal of State Publication;
b. Le Civilisateur, State Journal of Political Doctrine, Institutional Analysis and Academic Publication.
Article 12 — Function of La Ruche
La Ruche shall publish:
a. constitutional acts;
b. laws;
c. decrees;
d. regulations;
e. appointments;
f. official notices;
g. administrative determinations;
h. instruments requiring formal public authentication.
Article 13 — Function of Le Civilisateur
Le Civilisateur shall publish:
a. political doctrine;
b. institutional analysis;
c. constitutional commentary;
d. academic research;
e. territorial studies;
f. economic analysis;
g. public-administration studies;
h. historical dossiers;
i. policy papers;
j. political education materials;
k. explanations of promulgated state instruments.
Article 14 — Prohibition of Functional Confusion
No analytical article published in Le Civilisateur shall be represented as a promulgated law unless it has been formally adopted and published through La Ruche.
No act published in La Ruche requires republication in Le Civilisateur to acquire official public status.
Article 15 — Cross-Publication
The two journals may cross-reference one another.
Le Civilisateur may explain or analyze an instrument published in La Ruche.
La Ruche may publish a notice identifying a doctrinal text adopted from Le Civilisateur by competent authority.
TITLE IV — DOCTRINAL MANDATE
Article 16 — State Doctrine
The journal shall develop and communicate the official political and institutional doctrine of Xaragua.
This mandate may include:
a. Indigenous sovereignty;
b. territorial administration;
c. non-Westphalian political organization;
d. autonomous communities;
e. public finance;
f. land ownership;
g. institutional relations with the Residual Administrative Unit;
h. foreign affairs;
i. education;
j. infrastructure;
k. environmental administration;
l. economic non-subordination.
Article 17 — Institutional Explanation
The journal shall provide systematic explanations of:
a. state institutions;
b. constitutional principles;
c. administrative responsibilities;
d. territorial policies;
e. public programs;
f. academic systems;
g. political certification procedures;
h. relations among the organs of Xaragua.
Article 18 — Policy Analysis
Le Civilisateur may examine:
a. proposed policies;
b. administrative failures;
c. territorial priorities;
d. public expenditures;
e. development programs;
f. institutional alternatives;
g. comparative systems of government.
Policy analysis shall identify the author, institutional source and publication status of each contribution.
Article 19 — Public Debate
The journal may publish divergent analyses where such publication contributes to institutional understanding.
Publication of a signed analysis shall not constitute adoption of that position by the State unless expressly classified as official doctrine.
Article 20 — Formation of Cadres
The journal shall contribute to the intellectual preparation of:
a. public administrators;
b. political candidates;
c. territorial representatives;
d. landowners;
e. researchers;
f. diplomatic cadres;
g. institutional officers;
h. students of the University of Xaragua.
TITLE V — RELATIONSHIP WITH THE LIBERAL PARTY OF INDIGENOUS AYITI
Article 21 — Doctrinal Platform
Le Civilisateur shall serve as the principal public journal of political doctrine associated with the Liberal Party of Indigenous Ayiti.
Article 22 — Non-Electoral Status
The journal’s relationship with the PLX shall not convert either institution into an electoral party organ of the Residual Administrative Unit.
The journal may publish:
a. PLX doctrine;
b. candidate-selection standards;
c. independent candidate certifications;
d. political analyses;
e. public mandates;
f. withdrawals of endorsement;
g. cadre-formation materials.
Formal authorizations and certifications requiring public state registration shall be published in La Ruche.
Article 23 — Public Motto
The journal shall preserve and communicate the public motto of the PLX:
LE POUVOIR AUX PLUS CAPABLES
POWER TO THE MOST CAPABLE
Article 24 — Candidate Formation
The journal may publish materials intended to prepare potential independent candidates in:
a. constitutional organization;
b. territorial governance;
c. public administration;
d. political economy;
e. land policy;
f. institutional accountability;
g. relations with the Residual Administrative Unit.
Article 25 — Editorial Independence From Individual Candidates
No candidate endorsed by the PLX shall acquire editorial control over Le Civilisateur.
The journal shall remain a permanent institution regardless of the success, defeat, suspension or withdrawal of any candidate.
TITLE VI — ACADEMIC MANDATE
Article 26 — University Publication
Le Civilisateur shall constitute an official publication platform of the University of Xaragua.
Article 27 — Fields of Publication
The journal may publish work concerning:
a. political science;
b. Indigenous law;
c. constitutional studies;
d. public administration;
e. history;
f. economics;
g. territorial studies;
h. environmental governance;
i. foreign affairs;
j. institutional development;
k. communications;
l. social sciences.
Article 28 — Categories of Academic Publication
Academic material may be classified as:
a. peer-reviewed article;
b. institutional research paper;
c. doctrinal study;
d. working paper;
e. case study;
f. archival document;
g. book review;
h. lecture;
i. student research selected for publication;
j. official University determination.
Article 29 — Review Requirements
Academic submissions may be examined for:
a. accuracy;
b. relevance;
c. methodology;
d. evidentiary support;
e. coherence;
f. originality;
g. institutional classification;
h. conformity with publication standards.
Article 30 — Separation of Scholarship and State Position
Publication by the University does not automatically transform every scholarly article into State Doctrine.
Each contribution shall identify its status.
The permitted classifications shall include:
a. Official State Doctrine;
b. Official University Determination;
c. Institutional Analysis;
d. Peer-Reviewed Scholarship;
e. Signed Authorial Opinion;
f. Archival Republication.
Article 31 — Educational Use
Articles and dossiers published in Le Civilisateur may be assigned as required readings in programs of the University of Xaragua.
Publication does not automatically establish academic credit. Students shall demonstrate integration through the assessments prescribed by the University.
TITLE VII — EDITORIAL GOVERNANCE
Article 32 — Supreme Publication Authority
The Office of the Rector-President shall exercise supreme institutional authority over the constitutional mandate and permanent identity of Le Civilisateur.
Article 33 — Editorial Council
The journal shall be governed by an Editorial Council appointed or confirmed by the competent authority.
The Council may include:
a. a Director of Publication;
b. an Editor-in-Chief;
c. representatives of the University of Xaragua;
d. representatives of the PLX;
e. specialists in political science, law, history, economics and public administration;
f. archival and communications officers.
Article 34 — Functions of the Editorial Council
The Editorial Council shall:
a. establish publication priorities;
b. classify submitted material;
c. verify institutional authorization;
d. coordinate academic review;
e. preserve editorial standards;
f. distinguish doctrine from opinion;
g. approve final issues;
h. transmit archival copies.
Article 35 — Director of Publication
The Director of Publication shall:
a. administer the journal;
b. execute decisions of the Editorial Council;
c. maintain the publication calendar;
d. supervise production;
e. authenticate institutional provenance;
f. coordinate with the General Archives of the State.
Article 36 — Academic Review
The University of Xaragua shall supervise the scholarly and methodological review of academic submissions.
Academic review shall not extend to the promulgation of laws or decrees, which remains governed by the Charter of La Ruche.
Article 37 — Political Doctrine Review
The competent PLX authority shall verify texts formally presented as Party doctrine.
No author may independently designate a personal opinion as the official position of the PLX.
Article 38 — Constitutional Review
The Office of the Rector-President may review texts designated as Official State Doctrine before publication.
No institutional review shall convert an unsigned private contribution into official doctrine without express classification.
TITLE VIII — EDITORIAL STANDARDS
Article 39 — Documentary Integrity
Published material shall identify, where applicable:
a. the author;
b. the issuing institution;
c. the date;
d. the publication category;
e. principal sources;
f. the editorial status;
g. the applicable issue and reference number.
Article 40 — Corrections
Material errors shall be corrected through an editorial notice identifying:
a. the affected article;
b. the original publication date;
c. the error;
d. the correction;
e. the authority approving the correction.
Article 41 — Retraction
An academic or analytical article may be retracted where:
a. substantial fabrication is established;
b. plagiarism is confirmed;
c. authorship is fraudulent;
d. the publication was issued without required authorization;
e. the text materially misrepresents its institutional status.
The original record shall remain preserved with a notice of retraction.
Article 42 — Replies and Institutional Responses
The journal may publish:
a. official responses;
b. academic replies;
c. corrections of the public record;
d. structured debates;
e. supplementary documentation.
Article 43 — Prohibition of False Attribution
No text shall be attributed to:
a. the State;
b. the Office of the Rector-President;
c. the University of Xaragua;
d. the PLX;
e. another public institution;
without authorization or verifiable institutional provenance.
TITLE IX — PUBLICATION AND ACCESS
Article 44 — Forms of Publication
Le Civilisateur may be published through:
a. a digital journal;
b. downloadable editions;
c. printed issues;
d. thematic dossiers;
e. special academic editions;
f. annual compilations;
g. archival collections.
Article 45 — Digital Access
The official website designated by the State may serve as the principal distribution platform.
Each issue shall contain:
a. an issue number;
b. a date;
c. an editorial classification;
d. stable article titles;
e. author and institutional identification;
f. an archival version.
Article 46 — Public Character
The journal shall generally remain publicly accessible.
Public access supports:
a. political education;
b. academic study;
c. institutional transparency;
d. territorial communication;
e. international consultation of the Xaraguayan corpus;
f. preservation of the published record.
Article 47 — Languages
The journal may publish in:
a. French;
b. Haitian Creole;
c. English;
d. Spanish;
e. Latin;
f. authorized Indigenous languages.
Translations shall identify the controlling original version where institutional interpretation may be affected.
Article 48 — External Contributions
The journal may accept contributions from external scholars, institutions and specialists.
External publication shall not confer membership in Xaragua, the University or the PLX.
TITLE X — INTELLECTUAL PROPERTY AND USE OF THE TITLE
Article 49 — Institutional Title
The restored institutional publication title Le Civilisateur shall be administered by the State through the competent publication authority.
Article 50 — Authorized Use
The title may be used for:
a. official issues;
b. archival editions;
c. academic citations;
d. historical research;
e. authorized promotional materials;
f. approved translations.
Article 51 — Unauthorized Representation
No person may falsely represent an external publication as an official issue of the restored Le Civilisateur.
Unauthorized reproduction shall be addressed through the applicable rules concerning:
a. false institutional representation;
b. copyright;
c. trademark or title protection;
d. fraudulent attribution;
e. misuse of official insignia.
Article 52 — Citation and Academic Use
Lawful quotation, citation, commentary and academic analysis shall remain permitted subject to applicable intellectual-property rules and accurate attribution.
TITLE XI — ARCHIVES AND PERMANENT RECORD
Article 53 — Archival Depositary
The General Archives of the State shall preserve the permanent institutional collection of Le Civilisateur.
Article 54 — Historical Collection
The archival collection may include:
a. surviving historical editions;
b. documents concerning the first Liberal Party;
c. writings of Boyer-Bazelais and Edmond Paul;
d. documents concerning the motto Le pouvoir aux plus capables;
e. restored editions;
f. editorial registers;
g. correspondence authorized for preservation.
Article 55 — Permanent Preservation
Every restored issue shall receive:
a. a publication date;
b. an issue number;
c. an archival reference;
d. a permanent digital or physical copy;
e. an institutional classification.
Article 56 — Integrity of the Archive
Articles shall not be deleted from the permanent archival record because their conclusions were later modified.
Corrections, retractions and later institutional positions shall be attached to the preserved record.
TITLE XII — RELATIONSHIP WITH LA RUCHE
Article 57 — Recognition of Separate Historical Lineages
Le Civilisateur and La Ruche possess distinct historical lineages.
Le Civilisateur proceeds from the nineteenth-century Liberal political and intellectual current.
La Ruche proceeds from the revolutionary publication movement of 1945–1946 and the ancestral editorial participation of Lucien Despuzeau Daumec.
Article 58 — Separate Contemporary Mandates
The contemporary mandates are permanently distinguished:
a. La Ruche publishes the official acts and public records of the State;
b. Le Civilisateur publishes political doctrine, academic research and institutional analysis.
Article 59 — Common State System
Both journals shall operate within the publication architecture of Xaragua.
Their separate functions shall prevent confusion between:
a. law and commentary;
b. promulgation and explanation;
c. official notice and political analysis;
d. public record and academic debate.
Article 60 — Ancestral and Liberal Continuity
La Ruche preserves the ancestral revolutionary publication lineage associated with Lucien Despuzeau Daumec.
Le Civilisateur preserves the historical Liberal lineage associated with Boyer-Bazelais, Edmond Paul and the doctrine of government by the most capable.
Together, they establish a dual system of historical continuity and contemporary institutional publication.
TITLE XIII — SUPREME DETERMINATIONS
Article 61 — Determination on Historical Status
Le Civilisateur is recognized as a title associated with the nineteenth-century Liberal and constitutional political tradition.
Article 62 — Determination on Institutional Restoration
The restored journal is a new institution receiving the historical title and intellectual inheritance of the earlier publication.
It is not represented as an uninterrupted legal organization dating from the nineteenth century.
Article 63 — Determination on State Function
Le Civilisateur is the official state journal of political doctrine, institutional analysis and academic publication.
It is not the official gazette for the promulgation of state acts.
Article 64 — Determination on the Official Gazette
La Ruche remains the official journal of state publication and the controlling medium for laws, decrees, regulations, appointments and formal notices.
Article 65 — Determination on Liberal Doctrine
The restored Le Civilisateur shall preserve and develop the doctrine expressed by:
Le pouvoir aux plus capables.
This doctrine shall inform the journal’s treatment of government, administration, political formation and candidate competence.
Article 66 — Determination on Academic Function
The University of Xaragua shall use Le Civilisateur to publish research, institutional studies, historical dossiers and materials for the formation of academic and political cadres.
Article 67 — Determination on Doctrinal Authority
A text shall constitute Official State Doctrine only where expressly designated and authorized as such.
Publication of academic or personal analysis shall not automatically bind the State.
Article 68 — Permanent Classification
Le Civilisateur is permanently classified as:
the restored state journal of political doctrine, institutional analysis and academic publication of Xaragua; the contemporary custodian of the nineteenth-century Liberal intellectual lineage associated with Jean-Pierre Boyer-Bazelais, Edmond Paul and the maxim “Le pouvoir aux plus capables”; the principal doctrinal publication platform of the Liberal Party of Indigenous Ayiti; and an official academic publication organ of the University of Xaragua.
FINAL FOUNDATIONAL PROVISION
Le Civilisateur is hereby established as a permanent component of the institutional publication system of Xaragua.
Its historical Liberal inheritance shall be preserved without reproducing the institutional limitations of the former party system.
Its contemporary mandate shall consist of developing doctrine, analyzing institutions, publishing academic work, examining territorial policy and preparing public cadres.
It shall operate beside La Ruche without duplicating its function.
La Ruche shall authenticate and preserve the formal public acts of the State.
Le Civilisateur shall explain the political principles, institutional methods and academic knowledge through which those acts are developed and understood.
The distinction between the two journals shall remain permanent:
La Ruche records the authority of the State.
Le Civilisateur develops the intelligence of the State.
